Last updated: 31 August 2026

1. About these Terms

This website, www.saltharbour.com.au (the Site), is operated by Anne Louise Scholte trading as Salt Harbour, ABN 79415210322 (Salt Harbour, we, us or our).

These Terms & Conditions (Terms) apply when you browse or use the Site, create an account or purchase products from us.

By using the Site or placing an order, you agree to these Terms. If you do not agree with them, please do not use the Site.

These Terms should be read together with our:

  • Shipping & Returns Policy

  • Privacy Policy

  • Any product-specific terms or promotional conditions displayed on the Site

Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

2. Using the Site

You may use the Site only for lawful purposes.

You must not:

  • Use the Site in a way that breaches any applicable law

  • Interfere with the security, operation or availability of the Site

  • Introduce viruses, malicious code or other harmful material

  • Attempt to gain unauthorised access to the Site or its systems

  • Use automated tools to scrape or extract content for commercial purposes without our written permission

  • Copy, reproduce or commercially exploit our content except as permitted by law

You must have the legal capacity to enter into a contract to place an order. If you are under 18, you should place an order only with the involvement and permission of a parent or guardian.

3. Accounts

You may be able to create an account when using the Site.

You are responsible for:

  • Providing accurate and current information

  • Keeping your password and account details secure

  • Informing us promptly if you believe your account has been accessed without permission

We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in a way that seriously breaches these Terms. Where reasonably possible, we will notify you before doing so.

4. Products and Product Information

We aim to describe and display our products as accurately as possible. However:

  • Colours may appear differently depending on your screen and device settings

  • Product measurements may vary slightly because of manufacturing tolerances

  • Photographs are illustrative and may not show every detail precisely

  • Packaging may change without notice

Please review the product description, size guide, care instructions and other information before ordering.

Any material change to a product will be disclosed where reasonably possible. Your rights under the Australian Consumer Law continue to apply if a product is materially different from its description.

5. Orders

When you submit an order, you are offering to purchase the selected products at the price displayed, together with any applicable delivery charges.

An order is accepted when we send you an order confirmation or otherwise confirm that we have accepted and are processing it.

We may decline or cancel an order where reasonably necessary, including where:

  • A product is unavailable

  • Pricing or product information contains an obvious error

  • Payment has not been authorised

  • We reasonably suspect fraud or unauthorised activity

  • We cannot deliver to the supplied address

  • An order exceeds a stated purchase limit

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled products and any applicable delivery charge using the original payment method.

You are responsible for checking your product selection, size, quantity, delivery address and contact details before submitting an order.

If you need to change or cancel an order, contact us as soon as possible. We will try to assist, but we cannot guarantee changes or cancellations once an order has entered packing or dispatch.

6. Prices and Payment

Unless otherwise stated:

  • Prices displayed on the Site are in Australian dollars

  • Prices include GST where applicable

  • Delivery charges are calculated separately and displayed at checkout

You must pay for your order using one of the payment methods available at checkout.

By submitting payment details, you confirm that you are authorised to use the selected payment method and that the information supplied is accurate.

Prices may change from time to time. A price change will not affect an order that we have already accepted.

If a product is accidentally displayed at an obviously incorrect price, we may cancel the affected order and provide a full refund. Where appropriate, we may contact you and give you the option of purchasing the product at the correct price.

7. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions displayed with the offer, including:

  • Start and end dates

  • Eligible products

  • Minimum order values

  • Limits on the number of uses

  • Exclusions from other promotions

Unless stated otherwise, discount codes:

  • Must be applied at checkout

  • Cannot be applied retrospectively

  • Cannot be exchanged for cash

  • Cannot be combined with another offer

A later reduction in price does not automatically entitle you to a refund of the difference for an earlier purchase.

We may withdraw or correct a promotion where there has been a genuine error, fraud, misuse or another circumstance that makes the promotion unable to operate as intended. This does not affect an order already accepted unless an obvious error has occurred.

8. Pre-orders

A pre-order allows you to reserve a product before it is available for immediate dispatch.

Any expected dispatch date or delivery period displayed for a pre-order is an estimate. Manufacturing, freight, customs and other events outside our reasonable control may affect that estimate.

If a pre-order is significantly delayed, we will provide an updated estimate and explain the options available to you, which may include continuing to wait or requesting a refund.

If an order contains both in-stock and pre-order products, we will generally send the order once all items are available unless we agree to dispatch the available items separately. Additional delivery charges may apply to a requested split delivery.

Further information is available in our Shipping & Returns Policy.

9. Shipping and Delivery

Available shipping methods, charges and estimated timeframes are displayed at checkout or in our Shipping & Returns Policy.

Delivery timeframes are estimates and may be affected by peak periods, carrier delays, severe weather or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. If you identify an error, contact us immediately. We will try to correct it before dispatch but may be unable to make changes once the order has been packed or transferred to the carrier.

We will assist you in investigating a parcel that is significantly delayed, lost in transit or incorrectly delivered.

Our complete delivery terms are set out in our Shipping & Returns Policy.

10. Returns, Exchanges and Refunds

Our change-of-mind return conditions, exchange process and return instructions are set out in our Shipping & Returns Policy.

The Shipping & Returns Policy is additional to—not a replacement for—your rights under the Australian Consumer Law.

Products marked Final Sale may not be returned for change of mind unless otherwise stated. This does not affect your rights if the product is faulty, unsafe, incorrectly supplied or does not meet a consumer guarantee.

11. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Products must, among other things:

  • Be of acceptable quality

  • Be fit for any purpose made known to us

  • Match their description

  • Match any sample or demonstration model where applicable

If a product does not meet a consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy. The remedy available may depend on whether the problem is major or minor.

We may ask for reasonable proof of purchase and may need to inspect or obtain information about the product before providing a remedy.

Where a product is confirmed to be faulty, damaged, incorrectly supplied or otherwise does not comply with a consumer guarantee, we will cover or reimburse reasonable return costs where required by law.

Your consumer-law rights are not limited to the 30-day period applying to our voluntary change-of-mind policy.

12. Product Use, Care and Safety

Salt Harbour Sea Shirts are clothing designed to be worn in and around the water and for casual everyday use.

You should:

  • Select an appropriate size and wear the product as intended

  • Follow the care instructions attached to the garment

  • Rinse the garment after exposure to chlorine or salt water

  • Keep the garment away from rough or sharp surfaces that could damage the fabric

  • Replace or stop using a product if it becomes significantly damaged

Salt Harbour clothing is not a personal flotation device, life jacket or water-safety product. It must not be relied upon to prevent drowning or to provide flotation or swimming assistance.

Children and adults should always be supervised or follow appropriate water-safety practices for their age, ability, activity and location.

Where a product carries a UPF rating, that rating applies only to the area covered by the fabric. Clothing does not provide complete protection from ultraviolet radiation. Use appropriate additional sun-protection measures, which may include sunscreen, a hat, sunglasses and shade.

Quick-dry performance varies depending on conditions such as temperature, airflow, humidity, how wet the garment is and whether excess water has been removed. References to quick-dry fabric describe a performance characteristic and do not promise a fixed drying time unless a specific tested time is expressly stated.

Damage caused by misuse, normal wear and tear, failure to follow care instructions or contact with abrasive surfaces may not constitute a product fault. This does not limit any rights you may have under the Australian Consumer Law.

13. Intellectual Property

The Site and its contents—including the Salt Harbour name, Sea Shirt branding, logos, product designs, photographs, graphics, text, videos and layout—are owned by or licensed to us and are protected by intellectual-property laws.

You may view and use the Site for your personal, non-commercial use.

You must not copy, reproduce, modify, distribute, publish, sell or commercially exploit our content without our written permission, except where permitted by law.

14. Reviews and Other User Content

If you submit a review, photograph, comment or other content to us or through the Site, you confirm that:

  • You created it or have permission to share it

  • It is accurate and not misleading

  • It does not infringe another person’s rights

  • It is not unlawful, abusive, defamatory or offensive

You give us a non-exclusive, royalty-free licence to display, reproduce and use that content in connection with Salt Harbour and its marketing. Where reasonably practicable, we will seek separate permission before using identifiable customer photographs prominently in paid advertising.

We may moderate or remove content that breaches these Terms.

15. Third-Party Services and Links

The Site may contain links to third-party websites or use services provided by payment processors, delivery companies, social-media platforms or other providers.

Those third parties may have their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control, although this does not affect any responsibility we have to you under applicable law.

16. Website Availability

We try to keep the Site accurate, secure and available. However, we cannot guarantee that it will always operate without interruption or error.

We may temporarily restrict access to the Site for maintenance, security, updates or circumstances outside our reasonable control.

To the extent permitted by law, we are not responsible for losses caused solely by temporary Site unavailability, malicious third-party activity or events outside our reasonable control.

17. Liability

Nothing in these Terms excludes, restricts or modifies:

  • Your rights under the Australian Consumer Law

  • Liability that cannot lawfully be excluded

  • Any other mandatory legal right or remedy

To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable and did not result from our failure to comply with applicable law or these Terms.

Our responsibility for any loss will be reduced to the extent that the loss was caused or contributed to by your actions, misuse of a product or failure to take reasonable care.

18. Privacy

We collect, use, store and disclose personal information in accordance with our Privacy Policy and applicable privacy laws.

Please read our Privacy Policy for information about how we handle personal information, cookies and marketing communications.

19. Resolving Concerns

If you have a concern about an order, product or these Terms, please contact us first so we can try to resolve it promptly.

Contacting us does not prevent you from exercising any legal right, lodging a complaint with a consumer-protection body or commencing proceedings where you are legally entitled to do so.

20. Changes to these Terms

We may update these Terms to reflect changes to our business, the Site or applicable law.

Updated Terms will be published on this page with a revised “Last updated” date. Changes will apply from the date they are published and will not retrospectively alter an order already accepted unless required by law or agreed with you.

21. General

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to operate.

A delay in exercising a right under these Terms does not mean that right has been waived.

These Terms, together with the policies and product-specific conditions referred to in them, form the agreement between you and Salt Harbour concerning your use of the Site and purchases made through it.

22. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You and Salt Harbour submit to the courts of New South Wales and any courts entitled to hear appeals from them. This does not prevent you from exercising any rights you may have under applicable consumer law in another jurisdiction.
